Bangkok: Mongkolkitt Suksintharanon, Secretary-General of the New Alternative Party, has urged the Election Commission (EC) to declare the recent election results void ahead of a potential ruling by the Constitutional Court. He suggests that the EC file a request with the Central Administrative Court to suspend the announcement of the election results.According to Thai News Agency, Mongkolkitt submitted an additional letter to the EC, following his prior request for an investigation into the traceability of election results back to the original ballot. Saweang Boonmee, the EC Secretary-General, claimed that only the EC could trace the process, while former Deputy Prime Minister Wissanu Krea-ngam stated that traceability could violate the Constitution. Mongkolkitt is awaiting responses from the Ombudsman and the EC.Another issue raised by Mongkolkitt is the incomplete election process in all polling stations. Due to incidents such as ballot tearing and adverse weather conditions, a re-election has been sc heduled for three polling stations. However, Article 102, paragraph 2 of the 2017 Constitution requires that elections be completed simultaneously, complicating the possibility of invalidating only certain polling stations.Mongkolkitt proposed that the EC declare the election void, citing the re-election in three stations as a potential violation of Article 102, paragraph 2 of the Constitution. He emphasized that the decision to follow this proposal rests with the EC.Additionally, Mongkolkitt filed a petition with the Central Administrative Court regarding the annulment of the EC's regulations on overseas voting. He highlighted concerns about postal voting, noting that the live-streaming of votes and the involvement of intermediaries compromised voter secrecy, potentially violating Articles 83 and 85 of the Constitution.Mongkolkitt also pointed out issues with the consulate's role in signing ballot stubs on behalf of voters, which he considers discriminatory. He has requested a temporary injunction from the Central Administrative Court to suspend the announcement of election results, arguing that including overseas votes could cause irreparable damage.He stated that if the election is invalidated, he is prepared to run again, confident of retaining public support. Mongkolkitt clarified that his complaint is filed in his capacity as a candidate and chairman of the Anti-Corruption Network Foundation, without political party affiliation.
