Bangkok: The government is seeking public feedback on the new surrogacy law draft, inviting citizens to submit their opinions through the central legal system at www.law.go.th until July 31. Ms. Ploytalay Laksmisangchan, Deputy Spokesperson for the Prime Minister's Office, highlighted the urgency of updating the laws as Thailand enters an aging society with a rising trend of infertility. The advancement and increasing use of assisted reproductive technologies necessitate legal amendments to remain consistent with social context, relevant laws, and international standards.
According to Thai News Agency, Ms. Ploytalee stated that the government, through the Department of Health Service Support, Ministry of Public Health, is prioritizing updates to reflect current circumstances, particularly regarding surrogacy. The proposed amendments aim to balance access to medical technology and the protection of rights and well-being for children, service recipients, surrogate mothers, and medical personnel. The revisions also aim to enhance regulatory effectiveness, prevent commercial exploitation and human trafficking, and support Thailand's development as a Medical Hub within an internationally recognized legal framework.
Key aspects of the amended draft law include changing "husband and wife" to "spouse" to ensure equal access for married couples, increasing the number of officers to enhance law enforcement, adjusting service conditions for couples with foreign nationals, and allowing sperm, egg, or embryo owners to export their genetic material. Additionally, the draft proposes increased penalties for offenses to prevent and suppress human trafficking and exploitation, as emphasized by Ms. Ploytalee.
