According to Thai News Agency, Ms. Narumon Mekborisut, Deputy Director of the Consumer Foundation, revealed that the Court of Appeals has awarded compensation of 2,500 baht per person for the Diamond model and 2,000 baht per person for the Gold model. This follows scientific tests that found the number of coating layers did not match the advertised claims. The Gold model actually has 5 coating layers and the Diamond model 6 layers, while the advertisement stated 8 layers.
The court found that the advertising misled consumers into purchasing the product at a price higher than that of a regular pan, thus constituting a breach of contract. However, the court did not order a full refund for the pan because the test results showed that the product was still usable for cooking normally, contained no harmful substances or health effects, and the plaintiff did not exercise their right to terminate the contract. The claims for damages for physical harm, mental health, travel expenses, and punitive damages were dismissed due to insufficient evidence to confirm such damages.
In addition, the defendant must pay default interest at a rate of 7.5 percent per annum from June 30, 2017, to April 10, 2021, and a rate of 5 percent per annum from April 11, 2021, until full payment is made, along with paying court fees for both courts on behalf of the five plaintiffs.
This case began with a lawsuit seeking over 1.65 billion baht in damages in 2017. The lower court accepted it as a class-action lawsuit in 2020 and dismissed the case on November 15, 2023. However, most recently, on September 3, 2026, the Court of Appeal overturned the lower court's decision, ruling in favor of consumers on the issue of misleading advertising.
